Terms of Service

These Terms of Service (the “Terms”) are the contract between you and Curbshot for curbshot.app, the Curbshot iOS and Android apps, homeowner share links, and related services (the “Service”). We operate from the United States. Contact: [email protected].
By creating a shop, signing in, paying, or using the Service, you agree to these Terms and to the Privacy Policy. If you do not agree, do not use Curbshot.
The product
Curbshot is photo proof for trades. A shop shoots before, after, and punch photos on the job, then shares an unlisted link and a one-page PDF. iOS and Android ship when they ship. Web share links and website billing work now. Photo bytes live in private Cloudflare R2. The website and API run on Laravel Forge.
Curbshot records what was shot. It is not a warranty of the underlying trade work, not an insurance policy, and not legal advice. A PDF or share page is evidence of photos, timestamps, and punch status — not a certificate that the work meets code.
Who may use it
You must be at least 18 and able to form a contract. You use Curbshot as a business customer (a shop), not as a consumer buying a toy. If you open an account for a company, you represent that you can bind that company to these Terms.
Shop accounts
You need a shop account to shoot and sync. Do not share logins. You are responsible for activity on the account, including what every signed-in device uploads. Keep the password to yourself. If you think the account is compromised, reset the password and email [email protected].
One shop may sign in on more than one device (for example a phone and a tablet). That is still one shop, one bill.
Your photos and content
The shop owns the photos, job names, notes, punch items, logos, and other content it uploads (“Shop Content”). You represent that you have the right to shoot and share that content — including houses, streets, and people who appear in driveway photos — and that sharing it does not violate law or someone else’s rights.
You grant Curbshot a worldwide, non-exclusive license to store Shop Content, stamp photos, generate PDFs, sync to your devices, and serve the share links and files you create, only to operate the Service. That license ends when the content is deleted, except for copies a homeowner already downloaded or that we must keep under law (see Privacy Policy).
We do not claim ownership of your photos. We do not sell them. We do not put them in ads.
Share links
A /s/{token} link is unlisted, not secret. Anyone with the URL can view the job. Homeowners do not pay us and do not create accounts. You choose who gets the link. If you send it to the wrong person, that is on the shop. Deleting the job or the account makes the link 404. Existing links stay live if you only let the subscription lapse — we will not strand a homeowner because a trial ended.
Acceptable use
Do not use Curbshot to:
- Break the law, harass anyone, or share photos you have no right to share
- Upload malware, probe, or disrupt the Service
- Resell the Service as if you were Curbshot, scrape other shops’ data, or try to access another shop’s jobs
- Use the product to collect payment from homeowners through us — we never process the homeowner’s money
We can suspend or delete an account for abuse, unpaid bills, or a legal demand. We will try to email you first when that is reasonable.
Price, trial, and billing
- Monthly: $39 per month
- Annual: $390 per year
- Founding: $29 per month, locked for as long as that subscription stays active, offered to the first 100 shops
- Trial: 7 days and 3 jobs, whichever runs out first. Then pay, or the camera waits. Jobs, photos, and share links already created stay on the account.
Prices are in US dollars and may change for new subscriptions. A founding price that is locked stays locked while that subscription remains active. Taxes may be added by Stripe where required.
Subscriptions are purchased on the website, not in the app
Payment is processed on curbshot.app through Stripe Checkout and the Stripe Customer Portal. The Curbshot iOS and Android apps do not sell digital goods, subscriptions, or in-app currency through Apple In-App Purchase or Google Play Billing, unless a store later requires it. There is no buy button and no price in the app. If you subscribed on the website, manage the card, invoices, and cancellation on the website — not under your Apple ID subscriptions and not under Google Play subscriptions.
If Apple or Google later requires store billing for some downloads, we may add that as a second door. These Terms will say so. Until then, Stripe on the website is the only way to pay.
Cancelling stops future charges. You keep access until the end of the paid period unless we terminate for cause. Refunds are handled case by case; email [email protected]. Chargebacks without talking to us first may get the account closed.
Account deletion
You may delete the shop at any time from Settings in the app (Delete account) or by emailing [email protected]. Deletion permanently removes the shop, users, jobs, photos, punch items, device tokens, and share links, and cancels Stripe billing. We keep only records the law requires, such as Stripe invoices and tax history. There is no undo. A homeowner who already saved a PDF or a photo still has their copy.
App Store downloads — Apple is not a party
If you download Curbshot from the Apple App Store, you acknowledge:
- These Terms are between you and Curbshot only. Apple is not a party to this contract and is not responsible for the app or its content.
- Apple has no obligation to provide maintenance or support for Curbshot.
- To the maximum extent permitted by law, Apple has no warranty obligation. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app (if you paid Apple any). Apple has no other warranty obligation with respect to the app.
- Apple is not responsible for claims relating to the app or your possession and use of it, including product liability, failure of the app to conform to legal or regulatory requirements, and claims under consumer protection law.
- Apple is not responsible for investigating, defending, settling, or discharging any third-party claim that the app or your use of it infringes that third party’s intellectual property rights.
- You represent that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
- Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
Questions about the app, billing on the website, or these Terms go to Curbshot at [email protected], not to Apple.
Google Play downloads
If you download Curbshot from Google Play, these Terms are between you and Curbshot. Google is not a party to this contract and is not responsible for the app or for subscriptions purchased on the website through Stripe.
Service availability
The app is built to keep working on a driveway with no signal: jobs and photos save on the phone and sync later. The website, share links, and billing need the network. We do not promise uninterrupted uptime. We may change, suspend, or discontinue features. Offline copies on your phone are your working set; keep your own backups of anything you cannot afford to lose.
Disclaimer of warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, CURBSHOT DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant that stamps, timestamps, PDFs, or share pages will be admitted in every dispute, or that photos will be stored forever if you do not pay or if you delete the account.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CURBSHOT IS NOT LIABLE FOR LOST PROFITS, LOST DATA, COST OF SUBSTITUTE SERVICES, OR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, EVEN IF WE WERE TOLD THEY WERE POSSIBLE.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID CURBSHOT IN THE 12 MONTHS BEFORE THE CLAIM. IF YOU HAVE PAID NOTHING, OUR LIABILITY IS LIMITED TO ONE HUNDRED U.S. DOLLARS ($100).
Some states do not allow certain limitations. In those states, our liability is limited to the maximum extent permitted by that state’s law. These Terms do not limit liability that cannot be limited, such as liability for death or personal injury caused by our gross negligence where that bar is not allowed.
Indemnity
You will defend and indemnify Curbshot against claims, damages, and reasonable legal fees arising from Shop Content, your use of the Service, your share links, or your breach of these Terms, except to the extent a claim is caused by our willful misconduct.
Intellectual property
Curbshot, the Curbshot mark, the asphalt design, and the software are ours (or our licensors’). These Terms do not give you a license to copy the product, scrape it, or reverse engineer it except where the law says you may. Shop Content stays yours, subject to the license above.
Changes to these Terms
We may update these Terms. The date at the top will change. Material changes will be posted on this page. If you keep using the Service after an update, you accept the new Terms. If you do not, delete the account and stop using Curbshot.
South Carolina law and disputes
These Terms are governed by the laws of the State of South Carolina, United States, without regard to conflict-of-law rules. You and Curbshot submit to the exclusive jurisdiction of the state and federal courts located in South Carolina, except that we may seek injunctive relief in any court to protect the Service or intellectual property. You and we waive a jury trial to the extent the law allows. If a court finds a section unenforceable, the rest still applies.
Miscellaneous
These Terms and the Privacy Policy are the entire agreement for the Service. They replace prior terms. You may not assign the account without our written consent; we may assign these Terms in a sale of the product. Failure to enforce a provision is not a waiver. There are no third-party beneficiaries except Apple as stated above for App Store downloads.
Curbshot is the name of the product and the operator identified in these Terms. We do not list a company entity, tax id, or street address here.
